Welcome to the Kotobee Books website, which is owned and operated by Vijua (“Kotobee Books” “we” or “us”). The term "you" refers to the user or viewer of the Site, including writers, publishers, agents and readers. These terms of service (“Terms of Service”) are a binding agreement (“Agreement”) between you and Kotobee Books.

By using the service available at the Site such as creating an account, accessing and viewing content, or posting your own work (together with the Site, the “Services”), then you’re agreeing to these Terms of Service. If, however, you don’t agree to any of these terms, you can’t use the Kotobee Books Services.

Content guidelines

At Kotobee Books, our main goal is to create a safe and enjoyable space for everyone to share and discover new content. In order to achieve this, we want to make it clear to our users that there is some content that we don’t accept to be added to our platform.

The following content is not accepted or allowed on Kotobee Books.

Sexually explicit content; text, illustrations, images, videos, audio or any material which depicts graphic sexual acts and/or excessively objectionable or crude content are not permitted. Content that contains Compensated or non-consensual sexual acts, whether simulated or real is prohibited.
Hate speech - Hate speech will not be tolerated on the Site. Be aware of cultural differences and sensitivities. Some materials may be acceptable or legal in one country, but unacceptable or illegal in another.
Dangerous or Illegal content- Content published on Kotobee Books must comply with all applicable laws. We do not allow content that is illegal, promotes illegal activity, or infringes on the legal rights of others. This includes texts, images or videos that would encourage or help others to commit a crime (e.g. books describing the details of how to commit a certain crime).
Offensive Material - Extremely disturbing materials are not permitted on Kotobee Books. This includes content that we believe promotes harm or promotes the harassment, intimidation or abuse of, or discrimination against others based solely on race, ethnicity, sexual orientation, national origin, gender, religion, disability, disease, age or immigration status.
Intellectual property abuse - violates or is alleged to violate the intellectual property rights, privacy rights or other rights or protected interests of a third party.

We may update the list at any time and we also have the right to remove any content that we find inappropriate or against our rules. Kotobee Books has the right to close any account or remove any content without prior notice.

Writer’s rights and obligations

If you upload and publish your work to Kotobee Books, you understand and warrant that you are the legal publisher of this work and that you control all rights and assume all liabilities associated with the publication of this work; and you warrant and affirm that no aspect of your work violates or infringes the rights of another person, party or entity. You also warrant that you are the legal publisher of this work and that Kotobee Books is only acting in the role of publishing platform and retailer. The following describes the rights and responsibilities of the You and Kotobee Books and. Any user of this Site who downloads, reads or previews any Work on the Site is referred to as an “End User”.

1. The grant and the territory

You hereby grant and assign a non-exclusive worldwide right to Kotobee Books to digitally publish, distribute, market, and sell (“Publish”), the work identified on the front page of your submission (the “Work”). Since the terms of the agreement with Kotobee Books, herein, is non-exclusive, you are free to Publish, license, market and sell your Work elsewhere so long as you are not violating someone else’s agreement or violating any laws.

2. Publication and removal of works. Kotobee Books will generally Publish any submission which does not violate, nor appear to violate the Agreement.

Kotobee Books, however also reserves the right to remove your Work at any time and for any reason, and no reason need be provided. An example of those reasons would be if your Work violates any term of this Agreement or the content guidelines found in the previous section. So before posting any content to Kotobee Books, make sure you check the previous section “Content guidelines” and check whether or not your content complies with these guidelines. Kotobee Books will make every attempt to provide you with reasonable notice via email, up to and including providing instructions on how to remedy potential issues that might prevent Kotobee Books from listing or keeping your content.

It is your responsibility to upload a complete and properly formatted book. We urge all Kotobee Books writers not to waste the time of readers with incomplete or poorly formatted Works. Otherwise, Kotobee Books will have the right to remove any work if it was found to be incomplete or poorly formatted without prior notice.

3. Promotional Rights. Kotobee Books shall have the right to distribute samples of the Work in any form of media, in order to promote (a) the author or author’s Work and/or (b) Kotobee Books’ Services. These samples will be licensed for free, non-commercial use, duplication and sharing.

4. Author and Publisher Warranties. By uploading your content to Kotobee Books, you agree that any violation of the warranties below may result in immediate closure and deletion of your account and the forfeiture of accrued earnings.

a. By submitting your Work to Kotobee Books for publication, you, warrant that you are the author or exclusive publisher or designated author or publisher agent and you warrant and represent that the Work is complete and the author is the only author of the Work and is the sole owner of the rights herein granted;

b. You further warrant that the Work contains no materials which:

violate the rights of others, including without limitation others' privacy rights or rights of publicity (for example, bulk email lists, direct-mail marketing lists, publishing a person's private email address without their permission, etc);
plagiarize or pirate others’ work or violate any copyright, trademark or other proprietary rights;
Use celebrity images and/or celebrity names for commercial purposes without permission of the celebrity or their management. This includes unauthorized celebrity images.
post any information that is abusive, threatening, defamatory, libelous, obscene or racially, religiously, sexually or otherwise objectionable and offensive;
violates the laws of your jurisdiction;
Impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity;
advocates discriminatory, hateful or racist views or actions toward certain groups or people;
Upload to or display on the Site any confidential, proprietary or trade secret information of any third party; or any advertisements, solicitations, chain letters, pyramid schemes, investment opportunities or other unsolicited commercial communication (except for those that are expressly permitted by us);
advocate violent or illegal activities;
advocate or promote "get-rich-quick" systems and schemes;
contains or intended to be used as advertisements for products or services;
contains incomplete information and prompts the reader to access external resources or services that require registration or payment;
is an incomplete Work for the purpose of promoting the purchase of the complete book elsewhere;
Modify, sublicense, adapt, sell, reverse engineer, disassemble or decompile any portion of the Site;
makes false, inaccurate or misleading claims or promises in the content of the ebook or ebook description;
Use any robot, spider, site retrieval application or any other device or process to retrieve, index, data mine or in any way reproduce or circumvent the navigational structure or presentation of the Site;

c. You further warrant that your Work is a complete ebook and not an unfinished work in progress. You have to make sure that:

the uploaded file is not a partial sample, a sample chapter, a collection of sample chapters, or a catalog advertising other books or products.
the Work is complete and self-contained, and does not try to upsell the user to purchase, or register for, access to information that should have been contained in the book;

We reserve the right to suspend or terminate your access to and use of the Site immediately if you fail to comply with the above rules or otherwise fail to comply with these terms. A determination is to be made at our sole discretion.

Ownership of content and copyrights

You own all the rights to the content you create and publish on Kotobee Books. Refrain from submitting content which you don’t own the copyright for (unless you have permission, which includes granting Kotobee Books all the rights outlined in these terms).

You’re fully responsible for the content you publish on Kotobee Books. This means you assume all risks related to its publication and display, including someone else’s reliance on its accuracy and any claims relating to intellectual property or other legal rights.

It is your responsibility to place a copyright notice on the copyright page or some other prominent place in the Work.

How Kotobee Books deals with copyright issues

Kotobee Books takes claims of copyright infringement seriously and may take immediate action upon notice from someone claiming to be an infringed party. Kotobee Books deals with copyright issues in accordance with the United States Digital Millennium Copyright Act (the “DMCA”). We apply this policy globally to all jurisdictions in which our Services are available. Kotobee Books reserves the right to remove any content published on the Site if it was alleged to be infringing copyrights without prior notice, at our sole discretion, and without liability to you or anyone else. We may also delete a user’s account if the user is determined to be a repeat infringer.

If you learn that a third party is violating your copyright or pirating or illegally distributing your published work on Kotobee Books, you shall then inform Kotobee Books of this situation; however, it is your responsibility to seek relief from the offending parties. If that said work is published on Kotobee Books, Kotobee Books will do its best to remove it immediately.

It is your responsibility to secure permissions to the Work prior to the time you submit it to Kotobee Books if any material from the work belongs to, or has been licensed to, someone else.

Deleting your account

If you close your account, it will be permanently deleted along with all the content you posted on the Site. So, make sure you have a backup of your work and that your readers are aware that they don’t have access to your content anymore before you do so.

You agree that Kotobee Books may, in its sole discretion and without liability, terminate your account or cease providing you with all or part of the Services at any time and for any reason we deem appropriate. We will, however, make reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account.

Kotobee Books email policy

Kotobee Books does not engage in spam, nor does it share, rent or sell the personal contact information of its members with third parties.

As part of the signup process for Kotobee Books, you must give Kotobee Books permission to contact you via email. This is necessary to perform our service well for you. For example, if you publish a book, we need to inform you of your book's status and of new marketing opportunities.

Disclaimers, Limitations of Liability and Indemnification

Nothing in the following section is intended to limit any rights you may have which may not be lawfully limited.

Warranty disclaimer. Kotobee Books provide you with our Services, use of content and the Site “as is” and “as available”. Your use of our Services and any content is solely at your own risk and discretion. That means that your use of our Services doesn’t come with any warranty of any kind, expressed or implied.

Responsibility for Content. All content is the sole responsibility of the person who originated it. We may not control or monitor the content posted via the Services and we cannot take responsibility for it. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any content posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive.

Release. When you use the Services, you release Kotobee Books from claims, damages, and demands of every kind — known or unknown, disclosed or undisclosed, suspected or unsuspected— arising out of or in any way related to (a) the Services and (b) disputes between users, or between users and any third party relating to the use of the Services.

In no case shall Kotobee Books be liable to writers or end-users, or any other third party, for any special, incidental, indirect, exemplary, punitive, or consequential damages of any kind.

Third-party websites. The Site and Services may contain links to other websites. When you access third-party websites, you do so at your own risk. We don’t control or endorse those sites.

General Terms

Changes. Kotobee Books reserves the right to make changes to the Terms of Service from time to time. Therefore, you must check the Terms of Service regularly to check for such changes. Your continued use of the Site after the date of any modification of the Terms of Service will constitute your acceptance of the modified Terms. If you disagree with any changes in the Terms of Service and do not wish to be subject to the revised terms, you will need to close your account and/or stop using the Services.

Entire agreement. This Agreement is the whole agreement between Kotobee Books and you concerning the Services.

No waiver and severability. If Kotobee Books doesn’t exercise or enforce any portion of this Agreement, the parties agree that such invalidity will not affect the validity of the remaining portions of this Agreement.

Governing Law. In the unfortunate event where legal action does arise, these Terms of Service shall be governed by and interpreted in accordance with the laws of Egypt, without giving effect to its conflict of law’s provisions or your actual state or country of residence.

Acknowledgment. By using the Service, you acknowledge that you have read this Agreement, understand it, and will be bound by its terms and conditions.
